Terms & Conditions
This page applies to applications for, and study on, the CL Global Academy Programme and the provision by CL Global Academy of the Programme.
“Programme” means the course Programme, which will be organised by CL Global Academy or its affiliates and be participated in by the Participant.
“Programme Fees” means the fees to be paid by the Participant to CL Global Academy for attending the Programme at a price confirmed.
“Free Activity Period” means the period stipulated by CL Global Academy when Participant can determine his/her schedule within the Programme.
“Self-Arranged Period” means the Free Activity Period, the period when the Participant doesn’t attend the activities of the Programme, the personal period beyond the daily routine, and the personal period within CL Global Academy’s Leave from the Programme Team.
“Programme Team” means the group convened by CL Global Academy for the Programme consisting of all the students attending the Programme and the entourage offering assistance for the Programme.
“Leave from the Programme Team” means the Participant does not complete the scheduled routines with the Programme Team after the lead teacher’s written approval.
“Drop from the Programme Team” means the Participant leaves the Programme Team and not completing the scheduled routines together with the Programme.
“Participant Personal Programme Insurance” means the short-term insurance taking Participant’s life, body, property, or relevant interests as the objects of insurance, including but not limited to aviation accident insurance, the Programme accident insurance, and emergency rescue insurance.
“Withdrawal from the Course” means the Participant voluntarily withdraws from the courses under the Programme, or Participant involuntarily withdraws from the courses under the Programme as required by CL Global Academy in accordance with applicable.
“Force Majeure” means the objective event incurred by natural or social reasons that either Party is unable to foresee, avoid and overcome, including but not limited to natural disaster, war, acts of terrorism, civil riot or insurrection, strike, public health emergency or acts of governments.
“Accident” means the event incurred by the accidence other than any party’s intention or negligence, including but not limited to the traffic jam, delay of train or flight, and temporary closure of scenic spots.
“Losses of Business” means the economic losses resulting from Participant’s withdrawal from the Course pre-departure or post-departure within the Programme, including but not limited to the traffic fees for taking a plane (or vehicles or ships) (including the deposit), the dormitory accommodation fees (including the deposit), the shared rental for sightseeing buses for the Programme and other actual expenses incurred or to be incurred.
1. Applications and Accepting
1.1 Applications for a place to study on the Programme must be made online using the online application form by clicking on the "Enrol" button.
1.2 Decisions on admission to the Programme are made by CL Global Academy at its sole discretion, according to admissions criteria and subject to availability. CL Global Academy will notify you of its decision as to admission by email to the email address you give in your application form.
1.3 If CL Global Academy wishes to make you an offer of a place to study on the Programme (an Offer), the terms of that Offer will be communicated to you by email to the email address you give in your application form.
1.4 To accept an Offer, you must communicate that acceptance to CL Global Academy (Acceptance) by following the procedure for Acceptance outlined in the Offer.
1.5 Once you Accept an Offer pursuant to paragraph 1.4, a legally binding contract will come into existence between you and CL Global Academy on these Terms for the provision of education services (Contract).
2. Fees and Payment
2.1 Please refer to tuition & fees on this website for details of Programme Fees. The Participant shall pay the Programme fees in full to the bank account designated by CL Global Academy within 7 days of the Acceptance of the Offer. Programme Fees enable CL Global Academy to deliver the Programme to the Participant.
2.2 The Programme Fees shall cover the following:
· the course charge and other charges for other activities arranged by CL Global Academy within the Programme.
· overseas traffic fees incurred in the Programme.
· administration fee
· food costs, not including the dinner for Wednesday and Friday and three meals for Saturday and Sunday, including all other meals.
· dormitory accommodation fees within the period of the Programme.
2.3 The Programme Fees don’t cover the following:
· onshore bank charge for international wire transfers.
· round trip air tickets for the Participant.
· traffic fees for the Participant go to the visa centre and back.
· fees for Participant’s Personal Programme Insurance.
· other fees not payable by CL Global Academy hereunder, including but not limited to those charged for other activities attended by Participant beyond the stipulations and those incurred within the Self-Arranged Period.
· Participant’s personal fees incurred in the travel, including but not limited to the charges for non-free foods on the vehicles, excess baggage, laundry, telephone, drinks and wines within the accommodation, personal entertainment, personal medical treatment, looking for lost property and reward, and damages incurred for Participant’s personal reasons.
2.4 If the Participant fails to pay the Programme Fees in time as stipulated herein, it will be regarded as a voluntary Withdrawal from the Programme. CL Global Academy is then entitled to cancel relevant services and arrangements.
2.5 Unless otherwise agreed by the Parties, the Programme Fees shall be tax-inclusive price. Any tax and charges incurred to either Party for entering or performing this Contract shall be burdened by such Party and paid in accordance with the local laws.
3. Refunds and Cancellation
3.1 Full refunds of Programme Fees paid to CL Global Academy, will be made in the event of formal visa refusals and cases of serious illness supported by verifiable documentation.
3.2 Participant shall submit a written application and relevant supporting materials to CL Global Academy if Participant wishes to cancel the travel due to special circumstances not attributable to CL Global Academy’s faults (including but not limited to Participant’s sudden illness, accident, etc.). After obtaining the written consent of CL Global Academy, the Participant shall bear the liabilities for breach of contract in accordance with the following provisions and compensate CL Global Academy’s Losses of Business:
• If the Participant proposes to withdraw from the Programme in 60 to 90 days months prior to the start of the programme (including 90 days), the Participant shall pay 30% of the Programme Fees, and CL Global Academy will refund the remaining Programme Fees.
• If the Participant proposes to withdraw from the Programme in 30 to 60 days (including 60 days) prior to the start of the programme, the Participant shall pay 60% of the Programme Fees, and CL Global Academy will refund the remaining Programme Fees.
• If the Participant proposes to withdraw from the Programme within 30 days (including 30 days) prior to the start of the programme, CL Global Academy will not refund any fees.
3.3 All cancellations must be strictly in writing and sent by email to the below-listed contact details. Any cancellation must contain the Participant’s name, Programme dates and reason for cancellation (including any other information we should be aware of) and shall be effective upon the date of actual receipt by CL Global Academy.
3.4 If the Participant cannot complete the Programme for any reason whatsoever, no refunds of any nature will be applicable.
4. Participant’s rights and obligations
4.1 Participant is entitled to attend the courses and activities in accordance with this file and requires CL Global Academy to provide relevant services and assistance.
4.2 Whenever damaged by any third party in the process of attending the Programme, the Participant is entitled to require CL Global Academy to assist in complaining to the authorities, such as the industry and administration bureau or claiming compensation.
4.3 The Participant shall truthfully fill in the application form, student safety guard card and other materials relevant to the Programme as required by CL Global Academy and be responsible for the veracity, accuracy and completeness of the filled contents. CL Global Academy shall truthfully inform the Participant of his personal health information and variations relevant to the Programme after entering into this Contract and provide the contact information frequently used in person or easily to get into contact with himself.
4.4 The Participant shall pay Programme Fees and other charges in accordance with these terms and conditions.
4.5 The Participant shall complete the courses under the Programme and take necessary measures to prevent further losses of either Party when there is any event of Force Majeure or Accident.
4.6 The Participant shall observe and follow the laws and regulations in the location where the Programme take place, and shall not engage in any illegal activities, or take any part in pornographic, gambling or drug-related activities.
4.7 The Participant shall observe and follow the public order, the social morality and the local traffic rules, respect the local customs and the personalities of the service staff, behave civilised, not paint or carve on the scenes and architecture, spit anywhere or drop litter at his option.
4.8 Participant shall keep his own baggage safely, especially the valuables.
4.9 If any dispute arises in the process of the Programme, the Participant shall solve the problem on the basis of equal consultation and take proper measures to prevent further losses while shall not delaying the schedules by rejecting to board a flight, vehicle or ship, or Drop from the Programme Team.
4.10 Within the Self-Arranged Period, the Participant shall stay in the area where the Participant is able to control the risks and shall be responsible for his own safety.
4.11 CL Global Academy shall be not liable for any extra expenses arising or any Accident in connection with Participant’s Drop from the Programme Team or Leave from the Programme Team.
4.12 Participant shall provide CL Global Academy with legal and valid evidence in the situations where Participant’s legal interests would be damaged.
5. CL Global Academy’s rights and obligations
5.1 CL Global Academy is entitled to decide whether to accept Participant’s application for the Programme according to the health status and the relevant conditions of the Participant. If CL Global Academy finds that the health status and relevant conditions of the Participant is unable or unsuitable for attending the Programme, CL Global Academy is entitled to request the Participant’s Withdrawal from the Course without taking liability for breach of contract.
5.2 When the Programme Team is in an emergency, CL Global Academy is entitled to take emergency measures and require the Participant to cooperate and observe.
5.3 CL Global Academy is entitled to reject any unreasonable requirements of the Participant which is beyond the agreements under these terms and conditions.
5.4 CL Global Academy is entitled to assign part of its rights and/or obligations hereunder to a third party or subcontract part of services and relevant work to a third party, including but not limited to pre-departure preparations, purchasing insurances, teaching and scheduling, as well as take the responsibilities for such assignment and/or subcontract.
5.5 CL Global Academy shall provide the Participant with services according to the contents and standards herein.
5.6 CL Global Academy shall provide the Participant with the following services:
· arranging the Participant to attend the courses and activities in the Programme.
· arranging the Participant’s accommodation, dining and transportation in the location of the Programme within the period of the Programme;
· providing the Participant with guidance in different aspects, including but not limited to living, courses and activities and other relevant services.
5.7 CL Global Academy shall truthfully inform the Participant of specific arrangements and specific affairs, including but not limited to the important regulations and customs in the location of the Programme, the necessary measures, and emergency contact methods.
5.8 CL Global Academy shall provide the Participant with a safety guard card which needs to be filled in with Participant’s personal information (including Participant’s name, blood type, emergency contact methods and so on).
5.9 CL Global Academy shall make a true declaration and confirmative alarm to Participant about what may endanger the life or property safety, as well as the affairs which Participant needs to pay attention to and take reasonable and necessary measures to prevent damages. When the life or property safety of the Participant has been damaged, CL Global Academy shall take reasonable and necessary protective and rescue measures and prevent further losses of the Participant’s life or property.
5.10 CL Global Academy shall protect the personal information safety of the Participant and not leak any personal data/information of the Participant.
5.11 CL Global Academy shall actively coordinate and deal with the complaints made by the Participant within the period of the Programme. CL Global Academy shall take proper measures to prevent further losses for the Parties when any disputes arise.
5.12 CL Global Academy shall publish the advertisements and make propaganda materials in accordance with the principle of honesty and credibility.
6. Other Responsibilities
6.1 During the period of the Programme, if Participant's personal and property rights and interests are damaged due to any third-party infringement instead of CL Global Academy, CL Global Academy shall not be liable for compensation. However, if CL Global Academy fails to fulfil its security obligations, resulting in the enlargement of the Participant's losses of personal and property rights, the Participant shall bear the liability of compensation for the enlarged losses.
6.2 CL Global Academy is entitled to adjust the relevant schedule in the event of Force Majeure that makes the original Programme schedule cannot be carried out under normal circumstances, and this adjustment shall not be considered as a breach of contract.
CL Global Academy accepts enrolments and looks forward to welcoming all our participants. CL Global Academy reserve the right to make minor updates to the Coronavirus Policy in line with changes to ofﬁcial advice from the UK government or our accrediting body.
